Terms and Conditions

These terms and condition set out the basis upon which, BMW India Private Limited, carrying out the displaying and auctioning of available BMW Vehicles (through its Authorised Dealers).

By submitting the bid in the auction process, the bidder hereby unconditionally agree and accept to these Terms & Conditions. Bidder agree that it recognize that by participating in bidding process and on getting successful in the auction process, the successful bidder shall be obligated to purchase concerned BMW Vehicle.

Terms and conditions :

  1. The auction of BMW vehicles will be conducted on each Car basis. The successful bid will be announced and confirmed in favour of the person who have quoted the highest bid amount subject to the verification and adherence to these terms and conditions.
  2. The bidders are required to deposit “NON-REFUNDABLE” and “NON-ADJUSTABLE” participation fee of INR 2,000/- (Two thousand only) on each BMW Vehicle separately. The Participation Fee shall be deposited via online payment or way of demand Draft / NEFT drawn in favour of “Bird Automotive Pvt Ltd” payable at Gurgaon. The bidder must write his/her name, address, telephone/ mobile no. on the reverse side of the demand draft / pay order for the purpose of identification. If the bidder is not successful in the auction process, the participation fee shall not be refund for any reasons whatsoever.
  3. The details of the BMW Vehicle, list of statutory documents of each BMW vehicle will be available for inspection. The successful bidder have right to inspect the BMW Vehicle, (like colour, conditions, registration details & statutory documents) before submitting the bid. The Vehicle for display/inspection is available. The test drive of BMW Vehicle will not be available at the display location.
  4. The BMW vehicle shall be be sold at “AS IS WHERE IS” basis. Any claim in this regard will not be entertained in this regard. On getting successful in the auction process the delivery of BMW Vehicle will be arranged through Authorized Dealer subject to completion of necessary documents. The Authorised Dealer will complete the selling process.
  5. BMW India reserves its rights :-

    a. to refuse any bid without providing any reasons or justifications thereof.

    b. to accept any bid from a person who is acting as an agent for any prospective Buyer, known or unknown.

    c. to select and decide the Successful Bidder in the auction process. The decision of BMW India’s decision in this regard shall be final and binding on all parties.

    d. to cancel or revoke any bid if there is apprehension of bid rigging in auction process.

    e. to completely cancel the bidding process.

  6. The BMW vehicle shall be sold at “AS IS WHERE IS” basis. Any claim in this regard will not be entertained in this regard. On getting successful in the auction process, the retail invoicing and delivery of BMW Vehicle will administer by Authorized Dealer subject to completion of necessary documents. The Authorised Dealer will complete the selling process.
  7. An email confirmation will be sent to “Successful Bidder” promptly after winning the auction. The BMW Vehicle will be invoiced only through Authorized Dealer of BMW India from their respective location.
  8. The Successful Bidder requires to deposit complete bid amount to concerned Authorized BMW dealer. The Successful Bidder shall make 10% of the of the final auction price within two days of announcement of successful bid in his favour as advance payment and balance payment of auction price (with applicable taxes and other statutory charges, if any) shall be deposited within three day’s of receiving of confirmation email from BMW India or its Authorised Dealer. In case any failure or delay on part of Successful Bidder to deposit the amount, as stated above, the bidding shall be treated as cancelled subject to right of BMW India to forfeit the payment so far made by the Successful Bidder. No further communication will be held in this regard.
  9. The Successful bidder shall submit its requisite KYC documents like photo identification card, address proof, PAN card etc. as may be required for completing the auction process of BMW Vehicle.
  10. In the event of a Successful Bidder, delays, neglects or fails to with these terms and condition as per timelines stated above, BMW India also reserves the right to forfeit the advance payment and BMW Vehicle may be sold to any third party, as it may deem fit. The Successful Bidder agree to indemnify BMW India for any loss or damage sustained as a result of resale by BMW India.
  11. The final bid price is inclusive of GST only. All other statutory levies, registration fees and transfer fees, insurance shall be solely borne by Successful Bidder. The payment of the Registration Fee, Road Tax and other statutory levies shall be payable extra sole responsibility of the winner of the bid. Transportation or any other incidental charges will be borne by the Success Bidder. BMW India or its Authorised Dealer shall not be liable for any indirect, punitive, special, incidental or consequential damages arising out or in connection with the bid. BMW India shall not be liable for any loss or damage arising due to force majeure event. No cash payment. Payment only through proper banking channels. 1% TCS is applicable on the winning amount. Handling charges are applicable Rs 20,000 + taxes.
  12. BMW India shall not be liable for any act of omission or commission undertaken between the Dealer and the bidder in this regard.
  13. By participating in online auction process, bidder accepts and agrees to above terms and conditions and also gives his unconditional consent for being contacted for the Vehicle over his telephone/mobile phone/email/sms for the communication purpose. The Successful Bidder hereby his consent for using his contact details to be used by BMW India or its Authorised Dealer or their nominated agencies for completion the auction process and provide sales/services.. The bidder’s contact details will be shared with BMW India and/or its Group Companies for purpose of monitoring and conducting surveys to improve quality of services. The bidder hereby gives his/her consent for such data sharing and also has no objection whatsoever for such data sharing.
  14. All disputes are subject to jurisdiction of courts at New Delhi only.
